技术引进合同的管理我国对外经济贸易合作部及其授权的国家行政机关对我国境内的企业、其他经济组织,通过技术贸易和经济技术合作等形式,同中国境外的企业、其他经济组织或个人为引进技术所达成的技术合同关系依法进行的审查、批准活动。根据1985年5月24日国务院发布的《中华人民共和国技术引进合同管理条例》的规定:此类技术引进合同包括中方获得专利权的转让或使用许可合同;中方获得其他工业产权的转让或使用许可合同;中方获得专有技术的使用许可的合同以及技术服务合同。技术引进合同须具书面形式,并由中方当事人于双方签字之日起30天内提出申请书,报对外经济贸易合作部或其授权的其他机关审批;审批机关应当在收到申请书之日起60天内决定是否批准。
