【农村宅基地】农村居民个人(包括回原籍乡、村落户的干部、职工、城镇居民以及回家乡定居的华侨、港、澳、台同胞)取得合法手续用以修建住宅的土地,包括住房、厨房、牲畜圈舍、厕所和院落用地。不包括农民生产晒场用地。农户对宅基地有长期使用权,但无所有权,所有权属所在集体经济组织;对宅基地上的附着物享有所有权,有买卖和租赁的权利,不受他人侵犯,农户对宅基地不得买卖、出租和非法转让。出卖或出租后,宅基地的使用权就随之转移给受让人或承租人,但其所有权始终为集体所有。
