| 战俘 war，prisoner of 战争或武装冲突中被交战对方所俘获的合法交战人员。对战俘的法律地位作出明确详细规定的国际公约有：1929年的《关于战俘待遇的公约》，1949年《关于战俘待遇的日内瓦公约》，1977年《关于1949年日内瓦公约附加议定书》等。上述公约中规定合法交战人员包括参战的军人，志愿部队人员，游击队员，民兵，及其他因战争原因而遭受拘留的人员。战俘待遇的主要原则有8条：①拘留国应对战俘负责，给予人道待遇和保护；不得虐待和侮辱；不得作为人质，不得损害个人尊严。②不得没收战俘的私人财物。③战俘的住宿、饮食、医疗卫生应得到保障。④不得命令战俘从事危险性和屈辱性的劳动。⑤战俘可以拘禁，但除对违反法令的战俘适用刑事和纪律制裁外，不得监禁。⑥战事停止后，应立即遣返，不得延误。⑦在任何情况下，战俘不得放弃公约所赋予的权利的一部或全部。⑧在一人是否具有战俘地位发生疑问时，未经主管法庭作出判决之前，享受本公约的保护。虽然上述公约规定了对战俘的各种物质和人格尊严的保护，但在实际战争状态中，战俘往往享受不到公约所赋予的权利，交战国双方破坏国际法关于战俘待遇的原则的规定是经常发生的。 |
