地役权
【地役权】为了使用自己土地的方便而使用他人土地的权利。受便利的土地称“需役地”，给予邻地便利的土地称“供役地”。地役权因需役地而设，因此不得与需役地分离而转让，或成为其他权利的标的。地役权是为了行使和维持其权利的必要的设置，但应选择供役地损害最少的处所。供役地所有人也可以使用其土地上的设置，但应按受益的程度分摊维持费用。如因土地状况发生变化，地役权无存在的必要时，法院在供役地所有人的申请下，应宣告地役权消失。
