The ecological tort is a new kind of tort, it is a new theoretical problem which is not only connected with the civil tort, the environmental tort and the ecological crime but also different from them, its fundamental concept, scope and legal features show interactive complex relationship which are formal elements on the tort relationship that are multi-level and multi-aspect.

After a brief introduction of the current system, this essay sums up its legal features, and then emphasizes the enforceable theoretical basis for demolition and relocation of urban housing, that is,social public interests, which serves as the legal critirion to decide whether a specific practice is legitimate or not.
