| 环境权 environmental right 公民享有在清洁、良好、适宜的环境中生活的权利。1960年，德国一位医生首先提出环境权的具体主张。他就某些国家向北海倾倒核废料而向“欧洲人权委员会”提出的指控中，认为该行为违反了《欧洲人权条约》中关于保障清洁卫生的环境的规定。1969年，美国一位学者以“公共信托理论”为根据，提出了公民享有环境权的理论。环境权理论已为一些国家作为公民的一种基本权利在宪法或法律中予以确认。1969年，美国《国家环境政策法》规定，每个人都应当享受清洁的环境。同年，《东京都防止公害条例》规定，全体市民都享有过健康、安全和舒适生活的权利，此项权利不能因公害而受到侵害。1972年，《联合国人类环境会议宣言》提出，人人有在尊严和幸福生活的优良环境里享有自由、平等和适当生活条件的基本权利。在法律上有两种不同的环境权理论：一是“绝对环境权说”，认为公民享有的环境权是绝对的，未经“全体居民的同意”不得改变环境；另一是“相对环境权说”或称“忍受限度论”，认为任何环境变化都会给居民造成一定的影响，应权衡其利弊，如危害未超过人们“忍受限度”且又给人们带来利益，则应当认为这种环境变化是“合理的”。 |
