发明专利发明专利是专利法保护的专利的三种类型之一,而且法律状态最为稳定技术价值最高。发明专利的发明是指对产品、方法或其改进提出的新的技术方案。可以分为产品发明和方法发明。产品发明是指一项以物质形式出现的发明，如机器、仪表、新材料、新物质等。方法发明是指一项以程序的过程形式出现的发明，如产品的制造加工工艺、产品的使用方法、化学方法、生物方法等。
我国《专利法》规定，以下各项，不授予专利权：
1.科学发现；
2.智力活动的规则和方法；
3.疾病诊断和治疗方法；
4.动物和植物新品种；
5.用原子核变换得的物质。
同实用新型专利相比，发明专利获得条件更为严格，在创造性方面，衫新型仅要求有实用性特点和进步。就新颖性而言，则不如外观设计要求高，外观设计新颖性不仅要求未有相同的外观设计被公开，而且还要求未有相似的外观设计被公知。
发明专利权期限为20年，而实用新型、外观设计则10年。
