【粼体土地建设用地使用权】农民集体和个人进行非农建设依法使用集体所有土地的权利。非农业建设用地包括农村乡镇企事业单位、村办企业、农民个人住宅、乡镇村的公共设施和公益事业等的建设用地。集体土地一般只能由本集体及其所有的成员拥有使用权，除了下列两种情况外，一般不允许全民所有制单位或城市集体所有制单位捅有集体土地建设用地使用权:1.全民所有制企业和城市集体所有制企业与农民集体举办联营企业，经过批准，农民集体可以按照联营协议将土地使用权作为联营条件，从而联营企业获得集体土地建设用地使用权;2.非农业户口居民和其他农业组织的农民按照有关法律政策规定使用集体所有土地作为宅基地的，可以取得该集体土地的建设用地使用权。集体土地建设用地使用权的产生情况比较复杂:1.乡(镇)村企事业建设及公共建设用地使用权的产生。1962年以前平调集体土地没有退还的，现确认用地单位具有集体土地建设用地使用权。1982年以前通过与被用地单位签订协议使用集体土地，取得集体土地建设用地使用权，由于1962-1982年这个阶段土地权属很不稳定，集体建设用地无法可依。因此，凡1982年以前与被用地单位签有协议而使用土地的乡(镇)村企事业单位，确认其集体土地建设用地使用权。1982年以后使用集体土地，按照《国家建设征用土地条例》和《土地管理法》有关规定，参照国家建设用地的标准进行过用地补偿和安置的，取得集体土地建设用地使用权。经过有关领导批准成同意，并进行了一定的土地调整或补偿的，沿用已撤销企事业单位闲置土地的，也可取得集体土地建设用地使用权。2.农民住宅建设用地使用权的产生，其来源主要有三种:一是祖辈私有的房屋宅基地转来，二是集体划拨，三是通过继承、购买房屋而取得。乡镇各项建设用地，应按照合理布局、节约用地的原则，进行规划，经批准后执行。对于用地标准，要按照不同行业和经营规模分别规定，严格控制。
