本约与预约约定将来订立一定合同的协议为预约，又叫预备合同；以后履行预约而订立的合同为本约，又叫本合同。凡订立有预约的即负有订立本合同的义务。在大陆法中，预约又细分为双务预约与单务预约。预约当事人双方负有订约义务者，为双务预约；预约当事人仅一方负有订约义务者，为单务预约，又叫片务预约。预约以发生将来订立本合同之债务为目的，属于债权合同，适用债权合同的一般原则，因预约所生之债权，与普通债权有同样的法律效力。
