【保险代理人的代理权利】代理人经保险人授权后，就可在代理权限内进行保险代理活动，一般保险代理人的代理行为有有权代理和无权代理两类。有权代理属于常规代理，是指保险代理人依法取得代理权，并在其代理权限内所实施的合法有效行为。而无权代理则是指保险代理人未取得代理权或在授权范围外以保险人名义实施的行为。保险代理人的权力主要来自保险代理合同中保险公司的授权，这种授权的来源，概括起来主要有:1.明示权力。这是指保险代理合同中保险人明确书面授予保险代理人的权力，如向何种人出卖保险单、出售什么样的保险单、如何收取保费等等。同时在代理合同中，也可以明文拒绝授予代理人某些权力，如拒绝授予代理人改变条款的权力。 2.默示权力。这是指代理人为实现代理合同目的所必需的附带行为的执行权力，也即公众合理地认为代理人应具有代理的权力。一般而言，合理性应根据代理人为尽其职责，通常必须采取的行为而加以判断，如代理人有向投保人出售人寿保险单的明示权力，因而也有收取第一次保险费的默示权力。 3.显有权力。所谓显有权力是指保险代理人已经行使，但保险人明知而未加以阻止，显然已经默认了保险代理人行为的一种权力。也就是说保险代理人可以用表意的权力约束委托人，即保险人。如果保险代理人以表意的权力进行某种活动，使第三者确信代理人是在合理和适当的权力范围内从事代理活动，那么，委托人就会受到保险代理人的代理行为约束，就是说委托人要对代理人的行为负责。就一般而论，保险代理人在权力范围内行使代理权时，保险人要对代理人的所有行为负责，包括代理人的欺诈行为、疏忽或错误陈述等。如保险代理人被告知不可以出卖汽车保险单给20岁以下的人，然而该代理人却让一位18岁的人投保了汽车保险，而且保险公司也已经收到了转交的保险费，那么就可以认为保险公司已默认并事实上赋于了保险代理人向20岁以下的人出卖此保单的权力。
