2.经济合同当事人在履约过程中有过错。即当事人的违约行为是主观上的过错所造成的。
3.有当事人违约行为所造成的损害事实。违约方的违约行为有致使对方当事人受到损害的事实，是违约方承担赔偿损失责任的必备条件。
4.违约行为与损害事实之间要有因果关系。
