WTO的决策机制
1． 协商一致规则
协商一致规则（Principle of Consultation and Consensus），是GATT和WTO及其法律制度运作的一项基本准则。即只要出席会议的成员方对拟通过的决议不正式提出反对就视为同意，包括保持沉默、弃权或进行一般的评论等均不能构成反对意见。下列事项的决策一般应实行协商一致规则通过才有法律效力，除非有特殊规定：第一，对《世界贸易组织协定》和多边贸易协定的修改，有特殊规定的除外；第二，下列豁免成员方的义务；（1）豁免决定所涉及的是某一成员方琳在有关期限内履行过渡期或分阶段实施期的任期任何义务；（2）某项有关WTO章程的豁免请示且在提交部长会议90天内；第三，对WTO协定附件4诸边贸易协议的增加；第四，争端解决机构按照《关于争端处理规则和程序的谅解》作出决定时，需一致同意。
2．简单多数据规则。
对于WTO一般的决议如果不能达到一致同意，则采用简单多数规则，但《世界贸易组织协定》另有规定的除外。
3、2/3多数通过规则。
下列事项采用2/3多数通过：第一，对《世界贸易组织协定》附件1中的多边货物贸易协定和与贸易有关的知识产权协定的修改建议；第二，对《服务贸易总协定》一至三部分以及附件的修改建议；第三，对《世界贸易组织协定》和多边贸易协定的某些条款修改意见提交成员方接受的决议；第四，新成员方加入WTO；第五，财务和年度预算决议。
4、 3/4通过规则。
对于非常2重大事项，如果成员方不能达成一致同意，则采用3/4多数通过：（1）条款的解释；（2）各项协定的修改，（3）豁免义务。
5、反向一致规则。
即只要不是有权投票者全体一致对有关事项提出反对，则视为全体一致同意。该项规则避免了1947年GATT%26#8220;一致同意%26#8221;规则的弊端，是一个重大的创新。该规则主要体现在《关于争端解决规则和程序的谅解》第16条等条款之中。
6、必须接受规则。
WTO的有些决议通过后只有经过所有成员方的接受才具有法律效力。下列决策采用必须接受规则：第一，对世界贸易组织决策制度（投票程序）的修改；第二，对1994年《GATT》第一条款（最惠国待遇）和第二条款（关税减让）的修改；第三，对《服务贸易总协定》第二条款（最惠国待遇）的修改；第四，对《与贸易有关的知识产权协定》第四条款（最惠国待遇）的修改。说明：补充资料仅用于学习参考，请勿用于其它任何用途。
