票据保证行为本身并不免除任何票据债务人的票据责任 ,但在票据保证人履行了自己的保证债务时 ,既可解除自己以及被保证人及其后手票据债务人的票据上的责任 ,并基于此产生了票据保证人的代位权 ;此权利在权利性质、取得权利的要件、行使时所遵循的程序、抗辩制度二进制适用等方面 ,都和一般的持票人的权利有一定的区别 ,是一种从取得上来看具有后位性、从内容上来讲具有复合性、可变性的票据权利。
