Convention on the Conservation and Management of Pollock Resources in the Central Bering Sea
zhong boilinghai xiaxue ziyuan yanghu yu guanligongyUG《中白令海狭鳍资源养护与管理公约》(conventiononthe Conservation and Management Of Pollock Reso~inthe Ceni司Beringsea)管理位于白令海中部的公海区内的狭鳍资源的区域性渔业公约(简称《公约》)。该公约于19毕落年2月订立，参加谈判和签署公约的国家有中国、日本、韩国、波兰、俄罗斯和美国。到1995年12月底，除美国尚未批准这一公约外，其他国家均已批准或核准了这一公约，其中中国、波兰、俄罗斯已交存了批准书。《公约》规定，《公约》应在至少4个签字国向保存机关交存批准书之日起第30天开始生效。到1995年12月底，《公约》尚未生效。自so年代中期开始，美国为保护其专属经济区内的渔业资源限制外国渔船在其2(X)海里专属经济区内捕鱼生产，特别是1988~1989年美国政府相继取消了所有外国渔船在其专属经济区内的狭鳍捕捞配额，中国、日本、韩国和波兰的大型拖网渔船转向白令公海生产。1988年白令公海的狭鳍总捕捞量147万吨，随后产量急剧下降，1夕男)年的捕捞量为91万吨，而1卯2年仅捕捞了1万吨。1991年2月美国和俄罗斯政府以白令海狭鳍与专属经济区内狭鳄为同一种群应加强保护为由，邀请中、日、韩、波4个有船在这一公海海域捕鱼的国家商谈，探讨制定白令公海狭鳍渔业的管理机制，最终6国达成《中白令海狭鳍资源养护与管理公约》。《公约》由序言、20条正文和一个附件组成。其主要内容为:①确定《公约》区域为白令海沿海国2(X)海里专属经济区以外的白令海公海区域，但为科学目的，在《公约》下的活动可在白令海内扩展到《公约》区域外。②《公约》的目标是在《公约》区建立狭鳝资源养护、管理和合理利用的管理机制，恢复并维持可实现最高持续产量的白令海狭鳍资源。③决策机制是以年会的形式讨论确定《公约》区域内的狭鳍的总可捕量和国别配额以及其他公约规定的事项。每个国家决策时有一个表决权，除总可捕量和国别配额在附件中另有规定外，其他实质性事项，如邀请观察员、修改《公约》、接受新成员的决策需共同协商。④设立科学技术委员会，委员会包括各方的代表，其任务是向年会提供科学建议。⑤遵循《公约》的规定，包括对渔船的要求和有关执法的规定。(刘小兵)
