In this paper, basing on the analy- sis of the illegal monopoly in software copyright permission, the authors hold that copyright abuses and abnormal markets are both of illegal monopoly.
本文通过对软件版权许可的非法垄断分析，认为版权滥用与有害市场具有非法垄断的共同特征，并提出在认定软件版权许可非法垄断的构成方面，应当充分注意版权人在版权贸易市场中的弱势地位，均衡软件版权许可给版权人和整个社会带来的利益，作出有利于版权人的判定。
