gongCheng chengbao工程承包(Projeet eontracting)具有施工资质的承包者通过与工程项目的项目法人(业主)签订承包合同，负贵承建工程项目的过程.工程承包合同可分为总承包、分项承包、分包、转包、劳务承包和设计一施工合同等方式。 总承包合同项目法人与承包商直接签订的关于某一工程项目的全部工作的协议。签订总承包合同需要经过一系列程序，包括招标、投标、评标和谈判协商，最终由项目法人与承包商协商一致、签订合同。总承包合同的当事人是总承包商和项目法人.项目中所涉及的权利和义务关系，只能在项目法人与总承包商之间发生。 分项承包合同项目法人与各分项工程承包商分别签订的某一分项工程的协议。各个承包商分别对项目法人负贵。整个工程可以约定由项目法人或其中一个主要承包商管理协调。分项承包合同的优点在于给项目法人充分的灵活性，获得最好的专业承包商以及缩短工期、节省由总承包商再分包的费用等。但若缺乏管理能力，就会带来严重困难和复杂问题。 分包合同总承包商在与项目法人签订某工程项目总承包合同之后，总承包商将该工程项目的某一部分工程或某一单项工程分包给分包商完成而与其签订的承包合同。分包合同的当事人是总承包商与分承包商。工程项目所涉及的权利义务关系，只能在总承包商与分承包商之间发生;项目法人与分承包商之间不直接发生合同法律关系。但是，分承包商要间接地承担总承包商对项目法人承担的相关工程项目的义务。 转包合同承包商甲向项目法人承包了某一工程项目之后，又将该工程项目转包给承包商乙，并与其签订的工程承包合同。转包合同与分包合同不同，它的特点是由承包商甲与项目法人签订的承包合同所规定的权利和义务，全部转与承包商乙，即合同当事人的权利和义务在项目法人与承包商乙之间发生效力。签订转包合同时，承包商乙应向承包商甲给付一定数倾的酬金。中国禁止这种转包行为。 劳务合同又称雇佣合同。它是项目法人、承包商或分包商(甲方)为建设工程项目，与雇佣劳务提供者(乙方)就雇佣劳务者参与施工活动所签订的协议。当事人双方在商定的各项条件基础上，以各个被雇佣人员的劳动量为单位，由甲方付给乙方人员相应的报酬。其特点是乙方只取得相应的酬金，而不承担甲方的风险，也不分享利润。 设计一施工合同项目法人将设计任务和施工任务都授予一个承包商完成，又称为总体合同或一揽子合同。设计一施工合同的特点是节省费用和时间，并有利于设计和施工技术的结合以及设计与施工的配合.
