由于国内DNA鉴定在刑事司法领域内的迅速普遍应用,基于采集鉴定材料法律正当 程序、DNA鉴定结论的审查和判断的内在规律要求,本文对DNA鉴定原理和特征、鉴定样本的 采集与法律规范、DNA鉴定结论证明力和证据能力三个方面进行了论述,从确保DNA鉴定的 科学性和正当程序原则出发建议完善刑事诉讼法的相关规定,立法制定《刑事案件DNA检验条 例》,在DNA实验室系统建立专门的质量控制和质量保证标准体系。

At present,the forensic medicine′s DNA examination technology is mainly applied in recognizing or removing the biological evidences appearing frequently at the scenes of criminal cases(such as homicide cases,rapes,malignant fights with weapon,group deaths and injuries,thefts,etc.
目前,法医DNA检验技术主要是应用刑事案件(命案、强奸、恶性械斗、群死群伤、盗窃等)现场上出现几率较大的生物物证来进行认定或排除,为诉讼提供客观、真实的证据。
