鉴于临时建设和临时用地的情况比较复杂，各地的管理体制和管理条件又不尽相同，因此，《城市规划法》第三十三条规定：“在城市规划区内进行临时建设，必须在批准的使用期限内拆除。临时建设和临时用地具体规划管理办法由省、自治区、直辖市人民政府制定。”
