tankuang quan eaikuang quan zhuanrang guanli bonfo《探矿权采矿权转让管理办法》(re酗ations for~-fe币ngexPlorationrightsand而ningrights)中国矿产资源法的主要配套行政法规之一，中国地质矿产法律体系的重要组成部分。于1998年2月12日由国务院发布，并自发布之日起施行(简称《转让管理办法》)。 《转让管理办法》是依据修改后的矿产资源法所建立的探矿权采矿权有偿取得经批准依法转让这一法律制度制定的，是对矿产资源法建立的原则制度的细化。“转让管理办法”从立法上建立和完善了中国探矿权、采矿权有偿取得和经批准依法转让的法律制度，肯定了探矿权、采矿权的财产属性。 《转让管理办法》对探矿权采矿权转让审批、转让的范围、转让的条件、转让的程序等都作了具体的规定。“转让管理办法”全文共18条，不分章节，采用条款式体例。第一部分(1~4条)为总则，规定了立法目的、立法依据、适用范围、转让审批管理机关及其审批权限。第二部分(5~13条)为程序性、实体性规定，主要规定了探矿权采矿权转让的条件、程序、评估、评估机构的认定和评估结果的确认等内容。第三部分(14~16条)为罚则，规定了违反本办法有关规定实施的处罚。第四部分(17~18条)为附则，规定了探矿权采矿权转让申请书格式的制定及本办法生效的时间。 本办法的发布实施，将探矿权采矿权转让纳入法制轨道，依法进行管理，适应了建立社会主义市场经济体制的要求，有利于建立公平竞争的矿业权管理体制，有利于促进矿产资源勘查、开采投资主体多元化的形成和发展，给矿山企业注人了活力，有利于运用法律手段管理矿业权市场，促进中国矿业发展。 (殷德仁彭绍贤李洪光)
