听证程序
听证程序是指行政机关在作出行政处罚决定之前听取当事人陈述和申辩，由听证程序参加人就有关问题相互进行质问、辩论和反驳，从而查明案件事实的过程。
听证的具体程序：
一、 当事人要求听证的，应当在公安机关告知后3日内用书面形式提出；
二、 公安机关应当在举行听证会的7日前，通知当事人举行听证的时间、地点；
三、 听证公开举行；
四、 听证由公安机关的法制机构指定的工作人员主持，本案的调查人员不得主持听证；
五、 当事人可以亲自参加听证，也可以委托1至2人代理；
六、 举行听证时，调查人员提出当事人违法行为事实、证据、理由、依据；当事人及其代理人进行申辩和质证；
七、 举行听证时应当制作笔录，笔录交由当事人审核无误后签字或盖章；
八、 对当事人在听证会上的申辩或质证，认真进行复核。
